THE GOVERNMENT APPROVES THE DRAFT BILL FOR THE GOOD USE AND GOVERNANCE OF ARTIFICIAL INTELLIGENCE

On 11 March 2025, the Council of Ministers has approved the Draft Bill for the Good Use and Governance of Artificial Intelligence, an initiative that seeks to establish a solid regulatory framework to regulate the development, marketing and use of artificial intelligence systems in Spain.

It aims to combine technological progress with the protection of fundamental rights, aligning with the directives of the European Union’s Artificial Intelligence Act and positioning the country at the forefront of regulation in this field.

In this way, the legislative text is posed as a balance between the need to mitigate the inherent risks of artificial intelligence and the importance of not slowing down innovation. For this purpose, it foresees the creation of a regulatory sandbox; a supervised test space that will enable the developers to test their systems in a controlled environment before their definitive deployment.

Another of the essential pillars of the draft bill is the reinforcement of supervision in particularly sensitive sectors such as health, justice and security, where the use of algorithms may have direct repercussions on citizens’ lives.

Control mechanisms are also reinforced to avoid algorithmic discrimination and biases in automated decision making, with frequent audits to check that these systems do not harm certain collectives.
